The short answer

How does Form I-9 differ from applying for employment authorization?

I-9 is used for employment eligibility verification by employees and employers or their authorized representatives. I-765 is a separate application associated with employment authorization. Completing an I-9 does not itself obtain immigration status or a work permit, and document choices must follow the official verification rules.

Place I-9 in the employment process

The I-9 page describes verification of identity and employment authorization for people hired for work in the United States. This is an employer-and-employee process, not a petition to create an immigration classification. U.S. citizens and noncitizens can encounter it, so its presence alone says nothing about a worker’s nationality.

Keep the hiring record distinct from a USCIS application file. A receipt for a benefit request is not automatically the document an employer may accept for every verification situation. The official I-9 instructions and lists explain the applicable documentary framework.

Separate the worker and employer responsibilities

Read the instructions for each participant’s part of the form. An authorized representative acting for an employer is a different role from an immigration attorney representing an applicant before USCIS. Clarify who is performing which task rather than using the word representative without context.

Use official document guidance rather than a preferred-document demand

Do not convert a list of possible documents into a statement that every worker must produce a Green Card or an EAD. Review the current acceptable-document guidance and any applicable official receipt or reverification rules. Questions about employment discrimination or an individual work-authorization record may need qualified assistance.

Protect the employment file

Employers and workers should use the appropriate workplace process for personal documents. This site has no document-upload requirement and does not perform employment eligibility verification. The free comparison below explains the difference between verification, a benefit request and an agency decision without evaluating any person’s authorization.

Keep verification evidence out of an application folder

A workplace request for a document should be reviewed in the employment-verification context. A family member helping with an immigration filing may not know the employer’s task or the applicable document options. Keep the original request and the official instructions available so that a question can be referred accurately. Do not send an entire immigration file when the actual process calls for a particular employment-verification record.
