The short answer

Why do immediate-relative and family-preference categories work differently?

The Department of State separates close qualifying relationships to U.S. citizens from numerically limited family preferences. Petition approval and visa availability are different questions. A category name should not be converted into a promised completion time.

What this guide covers

  • The numerical framework is different
  • Approval does not erase a preference waiting stage
  • Page-specific evidence and process boundaries

At a glance

  • The Department of State separates close qualifying relationships to U.S. citizens from numerically limited family preferences.
  • USCIS distinguishes a family petition from the residence benefit, and the Department of State separately addresses numerical availability in the immigrant-visa process.
  • Use the actual process owner and page-specific records for the next question.

The numerical framework is different

The official family source says immediate-relative immigrant visa categories are based on specified close U.S.-citizen relationships and are not numerically limited each fiscal year. It separately describes family-preference categories as subject to annual numerical limits. Those statements explain the category structure; they do not mean that an immediate-relative case is automatic, that every relative of a citizen is immediate, or that no other processing requirement applies.

A visa-availability discussion makes sense only after the category is accurately identified. Preserve the classification stated by the agency and any later event that may require review. Do not choose a more favorable chart merely because the relationship can be described in several everyday ways.

Approval does not erase a preference waiting stage

USCIS distinguishes a family petition from the residence benefit, and the Department of State separately addresses numerical availability in the immigrant-visa process. A preference case should retain its actual category and priority record instead of assuming approval makes a number immediately available. Changes in marital status or the petitioner’s citizenship may create another category question and should be documented accurately.

Establish the documented relationship and category before reading a queue-related source. Keep the category and country assumptions visible. Ask about later changes separately instead of treating an old classification as permanently fixed.

Evidence that explains this particular question

Relationship record: Identify the exact family connection being evaluated. Petitioner record: Preserve the status or citizenship evidence relevant to the inquiry. Category notation: Keep the classification stated in the agency record. Availability reference: Identify the official chart or notice being consulted rather than an estimated date.

For example, the spouse of a citizen and the sibling of a citizen are both family relationships but do not share the same numerical framework. The petitioner’s citizenship alone does not make every relationship immediate. Keep the exact category visible before asking about availability or the remaining residence stage.

The boundary to resolve before the next step

Retain the official category name and petition history when checking numerical availability. A current category question can be different from the category that applied before a marriage, birthday or petitioner citizenship change.
