Can an ordinary job become H-3 by calling it training?
H-3 distinguishes a structured trainee program from ordinary employment, with a separate special-education exchange framework. The proposed training needs defined objectives, supervision and an explanation of its availability abroad; productive work is not an unrestricted substitute for training.

Identify the trainee program rather than a convenient title
For the general trainee route, the regulation addresses training unavailable in the person’s country and preparation for a career outside the United States. A business cannot establish that purpose merely by renaming an ordinary vacant job trainee. Graduate medical education is not the general H-3 training category.
Describe the curriculum and supervision
The petition’s program description addresses structure, supervision, classroom and on-the-job components, remuneration and the career abroad. It should explain what will be learned and how progress will be evaluated. A broad promise to learn the business leaves the actual training purpose unresolved.
Keep productive employment limited to its training role
The trainee framework does not permit placement in an ordinary operating position regularly filled by workers. Productive employment must be incidental and necessary to training. Separate actual learning tasks from routine service delivery rather than assuming that every task becomes training because a supervisor is present.
Do not merge the special-education route into the general rule
The regulation separately describes participants in structured special-education exchange training involving children with disabilities. That framework has its own facility, staff and participation requirements. It should not be summarized as an exception allowing every caregiving or classroom job to use the general trainee category.
Use program evidence that can be checked
A timetable, learning objectives, trainer qualifications and evaluation method can help explain the actual proposal. These materials should come from the real program, not a sample copied to fit a category. The free comparison organizes the distinction without deciding an individual’s eligibility or approving productive work.
A training schedule should show how classroom instruction, practical exercises and supervision fit together. Identify the evaluation method and the trainer’s actual capacity to provide the program. This gives the reader a concrete distinction between a defined learning program and an ordinary position with occasional informal instruction.
