How should I review a USCIS FOIA response with withheld pages or missing records?
Keep the determination, released files and request description together. Distinguish a withheld portion, a stated search result and a record that was never requested. A FOIA release is access to agency material, not a new immigration decision or a certification that every historical statement is accurate.

What this guide covers
- Match the response to the request actually made
- Keep the determination with the released files
- Distinguish redactions from factual conclusions
At a glance
- Match the response to the request actually made before proceeding with this task.
- Keep the determination with the released files and preserve the source record.
- Use the current official instructions and keep a dated record of the actual result.
Match the response to the request actually made
Compare the control reference, subject and described scope with the final request copy. A release responding to a narrow document request is not necessarily intended to include a complete file. Preserve the acknowledgment and later determination so a reviewer can distinguish the requested scope from assumptions about what every immigration record should contain.
Keep the determination with the released files
Read the agency's explanation of its action and any withholding, referral or review instructions. Do not detach a page of records from the letter that explains the production. Save the original download or file set privately and work from a separate reading copy so page order and release markings remain inspectable.
Distinguish redactions from factual conclusions
The DHS handbook describes agency review and material withheld under law. A blacked-out passage is not an invitation to infer the hidden text, and a released statement is not automatically an endorsement of its accuracy. Preserve the markings and identify the question without inventing the missing content or treating every omission as a deliberate adverse finding.
Track record gaps precisely
Create a private list of expected items, actual page references and the reason each item was expected. Distinguish an unreadable file, a record outside the request, a withholding and a stated unsuccessful search. Those are different questions for official clarification or qualified review, not interchangeable proof that the underlying immigration history is resolved.
Separate access review from a benefit or correction action
Read any review rights in the actual determination and applicable current rules without assuming a universal challenge route or period. If a disclosed record raises a factual discrepancy, preserve its owner and source for a separate correction inquiry. This free reading guide does not change a file, select a legal remedy or predict a benefit outcome.

Common questions
Does a FOIA release certify every statement in the file is true?
No. It provides access to released agency material. Preserve the source and context of a statement and distinguish access from a new adjudication or accuracy finding.

Can I infer what a redacted passage says?
Do not invent withheld content. Keep the release markings and the determination explaining the agency's action for any appropriate review question.

Why keep the original request when reading the response?
The response needs to be compared with what was actually requested. A narrow request and a complete-file assumption can create a false impression that material is missing.

Does finding an error in released records automatically correct it?
No. Access and correction are separate tasks. Identify the record owner and use the applicable current route for any correction question.
