The short answer

How should an I-765 research file distinguish the claimed category from proof that its conditions are met?

Index the actual work-authorization category being researched and the source records associated with it. Keep an underlying immigration process separate from a determination that the person qualifies for employment authorization or may begin the proposed work.

What this guide covers

  • Identify the category being examined without guessing it
  • Separate the underlying request from the work-authorization request
  • Read an existing card and notice as different records
  • Make category-specific supporting documents identifiable
  • Record the work question without promising a start date

At a glance

  • Category reference and underlying matter answer different evidence questions.
  • Preserve the original source behind each i765 category evidence index entry.
  • A completed organizer does not establish eligibility or replace current official instructions.

Identify the category being examined without guessing it

The I-765 form is used for employment authorization requests in a range of situations, so its document organizer should identify the category being examined rather than infer it from a job offer or a familiar visa label. Start with the current official form instructions and any category information actually printed on existing records. A proposed category is a matter for appropriate review against the person's circumstances. The index can state where the proposed label came from and what documents are available, without representing an unsupported label as proof that its conditions are satisfied.

Separate the underlying request from the work-authorization request

The current I-765 page illustrates why the underlying record matters. Its guidance for category (c)(9) refers to an I-485 filing or evidence that Form I-485 is pending. Its category (c)(26) filing guidance refers to the applicant's I-539 and an H-1B spouse's I-129. Those are different request relationships, not interchangeable evidence labels. Keep the relevant underlying receipt or decision linked to the I-765 inquiry and identify which submission each notice addresses. A category number supplies context for reviewing the instructions; it does not independently establish that an individual meets all requirements for that category.

Read an existing card and notice as different records

If a physical employment authorization document exists, inventory its named person, category information and printed dates alongside the associated notices. A copy of the card, an approval notice and an online case-status entry should retain their individual labels. Do not extend a date or assume an automatic effect merely because a new filing was submitted. The current official guidance must address any question about continued authorization, a replacement or another request. The organizer's useful contribution is to make the existing evidence legible and traceable, not to determine when employment may legally begin or continue.

Make category-specific supporting documents identifiable

Supporting evidence should be grouped by the particular condition it is intended to document. Identity material, an underlying agency record and a school or employer document can serve different roles even when all appear in one packet. Preserve complete pages and the issuer's wording, including any limitation on the document's purpose. If a translation is needed, keep it paired with the precise source record. A reviewer should be able to identify why an item is present, rather than infer its relevance from a broad folder name such as work papers or from the volume of attachments.

Record the work question without promising a start date

Finish by identifying the unresolved practical question and the documents needed to examine it: an unclear category entry, a missing decision, a discrepancy on a card or a planned employment event. Place proposed dates in a separate planning column so they cannot be confused with government-issued dates. Check the current I-765 information for the relevant process, including any changing instructions or policy notices. A focused evidence index supports an informed review while avoiding the unsafe assumption that a requested category, a pending receipt or an employer's preferred start date establishes work authorization.

Common questions

Does an underlying application automatically establish work permission?

Do not assume that. The actual category, authorization record and current rules need separate review.

Should a prior authorization be discarded when a new request is made?

Preserve the record history so existing and requested permissions can be distinguished.

Sources: Policy Manual: evidence

Does the index decide an automatic extension?

No. Current category-specific official guidance and the actual documents require review.

Can a job start date determine authorization?

An employer’s schedule is a planning fact, not an immigration decision.
