The short answer

Does any U.S. investment qualify for EB-5?

EB-5 is the immigrant-investor framework linking qualifying capital in a commercial enterprise with job creation. USCIS’s overview describes at least ten permanent full-time jobs for qualified U.S. workers. Investment, job evidence, project structure and immigration approval are distinct questions; a project’s marketing does not guarantee residence or financial returns.

What this guide covers

  • Identify the enterprise and actual investment
  • Read the job-creation component separately
  • Distinguish regional-center and other project settings
  • Separate lawful-source evidence from business forecasts
  • Keep immigrant availability and investment risk visible

At a glance

  • Identify the investor, enterprise and project structure.
  • Keep capital-source and transaction evidence distinct.
  • Separate job projections from documented results.

Identify the enterprise and actual investment

The inquiry concerns qualifying investment in a commercial enterprise, not merely buying a house or holding savings. Keep the investor, source of capital, enterprise and transaction trail distinguishable. A transfer receipt establishes a movement of money, not every legal requirement of the investor process.

Read the job-creation component separately

USCIS’s overview identifies ten permanent full-time jobs for qualified U.S. workers. That is different from a general projection of economic activity or an assertion that a business is useful. The applicable project structure and job-evidence methodology require the actual program instructions; do not count every contractor or predicted indirect benefit as an established qualifying job.

Distinguish regional-center and other project settings

Regional-center participation introduces a different program context from an investment outside that structure. Identify the actual project, enterprise and responsible parties rather than assuming one business brochure describes all legal roles. An organization’s program participation is not a guarantee that an individual petition or investment will succeed.

Separate lawful-source evidence from business forecasts

A business plan addresses proposed operations and jobs, while capital-source and transaction records address where money came from and how it reached the investment. Preserve genuine financial records and explain discrepancies without inventing a source. Forecasts should remain labeled as forecasts rather than being translated into completed business events.

Keep immigrant availability and investment risk visible

EB-5 has category-specific petition and later residence requirements, and Visa Bulletin lines can distinguish reserved and unreserved investment categories. This guide does not publish an unverified investment amount, current fee or filing deadline. The free table clarifies the evidence questions; immigration classification and financial due diligence remain separate decisions.
