Is NIW a separate category that bypasses EB-2 qualifications?
A national interest waiver is an EB-2 request to waive the job-offer and labor-certification requirement. The applicant must first establish advanced-degree or exceptional-ability eligibility. USCIS then examines the proposed endeavor, the person’s positioning and whether, on balance, waiving those requirements benefits the United States.

Establish the EB-2 basis before the waiver
USCIS’s current Policy Manual separates underlying EB-2 qualification from the national-interest waiver. A compelling public-interest idea does not replace the advanced-degree or exceptional-ability requirement. Identify the actual degree/experience or exceptional-ability basis before treating NIW as a standalone visa category.
Describe a specific proposed endeavor
An endeavor is more specific than an occupational title. Explain what the person proposes to do, how it would operate and the impact being claimed. A statement that doctors, engineers or teachers are important does not itself explain the national importance of this particular endeavor.
Read the first two prongs separately
The first prong concerns substantial merit and national importance. The second concerns whether the individual is well positioned to advance the endeavor. Evidence of an important subject is different from evidence of a plan, relevant record, progress or support showing the person’s ability to move that particular proposal forward.
Explain the balancing question without promising success
The third prong considers whether, on balance, it would benefit the United States to waive the job-offer and labor-certification requirements. This is not a universal shortage exemption or an automatic reward for a PhD. The current manual describes a contextual analysis rather than a document-count guarantee.
Keep self-petitioning and residence stages distinct
A qualifying NIW request can be self-petitioned. That removes the need for an employer to supply the waived job offer; it does not remove all forms, evidence or later visa-availability and adjustment/consular requirements. The free table separates the EB-2 basis and three-prong analysis without endorsing a personal endeavor or strategy.
A proposed endeavor should be described consistently across the plan, support letters and the applicant’s actual record. A broad occupation label in one document and an unrelated proposed project in another can obscure which endeavor is being assessed.
| Item | Actual distinction | Practical question |
|---|---|---|
| Foundation | Advanced degree or exceptional ability | Is EB-2 established independently? |
| Prongs one/two | Endeavor importance and individual positioning | Which evidence answers each question? |
| Prong three | Benefit of waiving job offer/labor certification | What supports the balancing request? |
