Does a pending immigration request authorize the activity I asked for?
A pending request is not an approval of the benefit or activity requested. A receipt, an existing classification, an employment authorization and a travel document answer different questions. USCIS’s change-of-status guidance specifically warns against starting a disallowed new activity before approval; other pending-case effects need their own current category-specific rule.

- Existing authorization and requested authorization are different
- The school example shows why pending is not approval
- Read later events without combining their effects
At a glance
- A pending request is not an approval of the benefit or activity requested.
- Existing permissions must be read separately from the new request.
- Stay, work and travel effects require their own category-specific authority.
First distinguish acknowledgement from adjudication
A filing acknowledgement records the request being received or accepted in the stated process. It should not be rewritten as a decision granting the requested benefit. Keep the exact form number, person and request identified in the notice so the word pending does not become a blanket statement about every immigration matter in the household.
The practical question is narrower than whether a case is open. Identify which proposed action needs authority now: continuing an existing activity, beginning a different activity, working or travelling. A record showing that USCIS has not yet decided a request does not by itself answer those separate questions.
Existing authorization and requested authorization are different
Compare the actual current classification or authorization with the new request. An I-765 filing, an issued EAD and authorization under the applicable category are distinct concepts reflected in the official employment-authorization source. A person should not infer permission to start work solely from an I-765 receipt or an employer’s expected start date.
This guide does not turn that caution into a claim that every receipt is irrelevant. Some category-specific rules can affect documents or activity, but they require the actual current rule and qualifying records. Do not copy a friend’s extension language or assume every request creates the same consequence.
The school example shows why pending is not approval
The official change-of-status page says not to change the activity before approval and specifically addresses a visitor beginning school. The student-change source likewise separates school acceptance, an I-20 and the government decision. A school document can support the plan while the authority required to begin the academic activity remains unresolved.
This makes the pending question different from selecting extension or change on a process map. The extension guide identifies the requested legal action. This page identifies the evidence needed before treating an unadjudicated request as current permission to perform a particular activity.
Read later events without combining their effects
A request for evidence, a petition decision, document production and delivery can happen at different stages. Link each new communication to its request rather than treating every update as either a final grant or a harmless shipping event. The official I-765 discussion distinguishes adjudication and card-related stages, which is useful when records appear out of sequence.
Preserve the complete decision if one arrives. The extension/change Policy Manual describes situations where a classification petition and a stay-related request have different outcomes. A single approval word in a message should not be assumed to resolve every related action.
Ask the specific stay, work or travel question
Use three separate headings for any unresolved effects: stay, employment and travel. Identify the actual category, existing records and requested benefit under each. This is more precise than asking whether a receipt makes someone legal, a phrase that can obscure several different legal concepts.
This page does not state that a pending request automatically maintains status, creates an authorized-stay period, prevents unlawful presence or grants employment. Nor does it declare the opposite for every category. Those are distinct legal questions requiring the controlling current source and individual facts. A checklist or consultation booking also does not extend a period or file a request.
| Record | Useful question | Do not assume |
|---|---|---|
| Receipt | Which request was acknowledged? | The benefit or new activity was granted |
| Existing authorization | What permission is already documented? | It covers every requested future activity |
| Later decision | Which action was granted or denied? | All related actions had the same outcome |
| Production or delivery record | What happened to a physical document? | A shipment is the substantive adjudication |

Common questions
Is a receipt the same as approval?
No. Identify the request acknowledged and preserve the later decision separately.

Does filing I-765 alone prove I can start work?
Do not infer that. The current category, authorization records and applicable rules must establish the work permission.

Can I begin a new course while a visitor-to-student request is pending?
The USCIS guidance requires the relevant approval before a disallowed study activity begins. A pending request or I-20 alone does not supply it.

Does every pending request have the same stay or travel effect?
No universal effect is stated here. Identify the actual request, category and current rule for each separate question.

What is the difference from the extension guide?
The extension guide identifies the legal action requested. This guide distinguishes an unresolved request from evidence of permission to act now.
