The short answer

Does my immigration document authorize the work I plan to do?

A job offer, nonimmigrant classification and EAD are different records. The I-765 source distinguishes requests for work authorization from documents showing it. The actual category and authorization rules must cover the proposed activity, not simply the existence of a pending case.

At a glance

  • A job offer, nonimmigrant classification and EAD are different records.
  • Form I-9 concerns an employer’s employment-eligibility verification process.
  • Use the actual process owner and page-specific records for the next question.

An EAD request is different from an issued authorization record

USCIS describes I-765 both in connection with requests for employment authorization and with obtaining an EAD evidencing authorization in the relevant circumstances. A receipt acknowledges a request; it is not the same as an issued card or a favorable decision. Identify the actual category and records rather than borrowing a code or expectation from another person’s card.

Describe who directs the activity, who receives the service and how compensation would work. These details can be more informative than employee or volunteer labels. Preserve them neutrally so a qualified reviewer can evaluate the arrangement without relying on the parties’ preferred terminology.

Employer verification does not create immigration permission

Form I-9 concerns an employer’s employment-eligibility verification process. It is not the employee’s application to obtain a work permit. Keep the employer’s document request separate from the immigration source establishing authorization. Likewise, an offer, onboarding appointment or payroll start date cannot substitute for the applicable government authority and the actual permission needed for the work.

Write a short description of the proposed work and identify who would receive the services. Collect the relevant classification and authorization records, then separate immigration questions from an employer’s document-verification process. Obtain a current review before treating an assumption as permission.

Evidence that explains this particular question

Proposed duties: Describe the services actually to be performed rather than an informal title. Classification record: Preserve the exact category and relevant agency decision. Authorization document: Identify what the actual document says without assuming it covers every employer or activity. Employer request: Keep onboarding questions distinct from the immigration analysis.

For example, an employer may send an onboarding request while a worker has only an I-765 receipt for the proposed authorization. The employer’s calendar and the agency’s record answer different questions. The practical review identifies the actual authorization covering the activity rather than treating the onboarding date as permission.

The boundary to resolve before the next step

Write down the proposed job and the existing authorization record rather than relying only on a document’s nickname. Keep any employer verification request separate from the agency record establishing permission.
