Does Australian permanent residence satisfy E-3 nationality?
E-3 is for Australian nationals performing qualifying specialty-occupation work. The proposed position, worker’s credentials, employer offer and certified Labor Condition Application are separate components. Australian residence alone is not the nationality requirement, and E-3 should not be treated as an H-1B cap-registration result.

Identify the Australian nationality requirement
The Department of State identifies E-3 as the Australian specialty-occupation category. Permanent residence in Australia is different from nationality. Keep the principal worker’s citizenship evidence distinct from family records; the Department separately explains that an eligible spouse or child need not be Australian to seek the dependent classification.
Examine the position and qualifications separately
The prospective work must meet the specialty-occupation standard, while the applicant must have the necessary relevant academic or other qualifying credentials. A degree does not by itself describe the employer’s job, and a job title does not establish the worker’s qualifications. Preserve actual duties and credential records.
Read the LCA and job offer as different records
The official visa guidance identifies an approved Labor Condition Application obtained by the U.S. employer, qualification evidence and the employer’s offer. The LCA is a Labor Department document, not the Department of State visa decision. Check that the employer, job and proposed terms refer to the actual arrangement.
Distinguish consular processing from a domestic request
An initial visa application abroad follows the consular instructions for that process. A change or extension request inside the United States is a separate USCIS matter. Do not import H-1B registration procedures simply because both categories concern specialty occupations.
Plan family and admission questions separately
The visa applicant must satisfy the category’s temporary-intent framework, and admission is a later government decision. A spouse’s nationality and employment-authorization questions should be reviewed under the specific dependent rules. This free organizer clarifies records without deciding a work-start date, visa outcome or individual change-of-status strategy.
E-3 is not an investor category merely because it shares the letter E. A business investment record does not replace the specialty job, employer offer, LCA or qualification evidence.
