Can every H-4 spouse work immediately?
A temporary worker’s spouse or child has a separate dependent classification and admission record. Work permission is not uniform: certain H-4 spouses must obtain an approved EAD, while qualifying L-2S and E-2S spouses have different incident-to-status rules. Those spouse provisions should not be applied to children.

Identify the dependent classification and relationship
H, L, O, P and R principals can have different family classifications, and not every temporary category has a matching dependent route. Preserve the marriage or birth evidence and the principal’s relevant record. A relative’s visa, admission period and status do not become identical to the principal’s merely because the family travels together.
Read the H-4 spouse EAD framework specifically
USCIS identifies certain H-4 spouses whose H-1B principal has an approved I-140 or the specified AC21 extension basis. These are eligibility routes to request employment authorization, not a rule that every H-4 spouse may work. The current guidance requires approval of the applicable I-765 before starting work; renewal and extension situations have their own rules.
Distinguish L-2S and ordinary E-2S spouse treatment
USCIS’s current L-1A family guidance describes qualifying L-2S spouses as work-authorized incident to status. Its E-2 family guidance describes the corresponding qualifying E-2/E-2S spouse treatment, with a separate E-2 CNMI exception. An optional EAD is different from a universal requirement to apply for the underlying work authority.
Keep the child and other dependent categories separate
The spouse rules do not create the same permission for dependent children. R-2 expressly prohibits employment, while O/P family treatment and TD must be read under their own framework. Do not generalize an E-2S or L-2S spouse statement into a rule for every dependent visa label.
Check the actual I-94 and document-verification question
USCIS describes an unexpired I-94 with the appropriate spouse designation as relevant work-authorization evidence in the stated L-2S/E-2S context. The employer’s Form I-9 verification question is separate from selecting an immigration strategy. The free comparison identifies the classification, spouse/child role and current evidence rather than declaring a particular person authorized to work.
| Item | Actual distinction | Practical question |
|---|---|---|
| H-4 spouse | Specific eligibility plus approved I-765 | Has authority actually been granted? |
| L-2S / qualifying E-2S spouse | Current incident-to-status framework | What does the admission record show? |
| Child or other dependent | Separate category rules | Has a spouse-only rule been wrongly copied? |
