Is H-2A the same as H-2B?
H-2A concerns temporary or seasonal agricultural labor. The employer’s temporary need, Labor Department certification, USCIS petition and the worker’s later visa/admission steps are connected but different decisions. A recruiter’s job offer alone is not the approved employer process or permission to begin work.

Identify the agricultural work and temporary need
H-2A is the agricultural category, rather than a general route for every low-wage or seasonal job. The employer must support the temporary or seasonal nature of the agricultural labor under the applicable framework. Keep the crop, operation, duties, work period and locations connected to the genuine job opportunity.
Understand the Labor Department’s separate role
The temporary labor-certification process concerns the employer’s labor need and applicable U.S.-worker and employment protections. A job order or recruitment document is not the same as the final certification. The employer’s certification records should remain identifiable rather than being replaced by a recruiter’s promise that paperwork is underway.
Follow the petition and visa sequence
The employer’s USCIS petition is a different step from labor certification. Where a visa is required, the Department of State conducts the visa process after the relevant petition stage, and CBP decides admission. A worker should be able to identify the actual employer and approved period rather than relying on the name of an intermediary alone.
Read actual job terms instead of informal assurances
Work locations, tasks and employment terms can matter to the approved arrangement. Keep the written offer and official job information available, and note discrepancies between them. This page does not invent wage rates, housing promises, transportation reimbursement amounts or recruiter authority for a particular job.
Distinguish a job change from an unchanged plan
A new employer, different agricultural assignment or altered timing can require a new procedural review. Do not treat a previous visa stamp as open-ended permission to work for any farm. The free checklist identifies the records and agencies involved; current category rules and the actual notices determine the next authorized step.
