Does supervising staff automatically establish L-1A managerial capacity?
L-1A concerns an intracompany transfer to a managerial or executive role within a qualifying organizational relationship. The foreign employment, relationship between businesses and actual U.S. duties are separate requirements. A manager title or a newly opened office alone does not establish the category.

- Separate foreign employment from proposed U.S. duties.
- Describe actual managerial or executive authority.
Trace the qualifying business relationship
The regulation distinguishes parent, branch, subsidiary and affiliate relationships. A shared brand or friendly business partner is not automatically a qualifying organization. Ownership, control and actual business operations need to be understood separately, including the connection between the overseas employer and the U.S. petitioner.
Keep foreign employment and U.S. work separate
The ordinary L framework includes qualifying employment abroad for the required period within the relevant lookback window. L-1A then concerns the proposed managerial or executive capacity. Record where and when the person worked, for which entity and in what actual role rather than assuming a current U.S. offer proves the earlier foreign experience.
Read managerial and executive duties as functions
The regulatory definitions focus on actual authority and primary duties, including managing an organization or essential function and high-level discretion. A first-line supervisor is not automatically a manager merely because people report to them. Staffing context and the organization’s stage can matter; headcount alone is not a complete test.
Treat a new office as a distinct factual setting
A U.S. office newly starting business raises additional premises, funding, business-plan and role questions under the regulation. An incorporation certificate or rented mailing address is not the whole operating-business record. Keep proposed development distinct from operations already occurring.
Do not convert L-1A into immigrant residence automatically
L-1A is a temporary classification. EB-1C is a separate immigrant-petition framework with its own requirements and decision. The free table helps compare organizational and role records, but neither a previous L approval nor a management title guarantees an immigrant petition or admission result.
The general L framework looks for at least one continuous year of qualifying foreign employment within the relevant three-year period. The appropriate reference point depends on the person’s situation. Keep the timeline and actual role evidence together rather than treating a single recent employer letter as proof of the entire required history.

| Relationship | Ownership/control and qualifying entities | What documents establish the connection? |
| Role | Managerial/executive primary duties | What authority is actually exercised? |
| Office | Existing operation versus new office | What business activity and resources exist? |
