Does an L-1A approval automatically establish EB-1C?
EB-1C concerns a multinational executive or manager offered qualifying U.S. work by a related employer. The corporate relationship, required foreign employment and actual managerial or executive duties are separate requirements. An earlier L-1A approval is not an automatic immigrant-petition approval.

- Document actual foreign employment and duties.
- Separate U.S. role from the earlier foreign role.
Trace the multinational employer relationship
The regulation defines qualifying relationships such as parent, subsidiary and affiliate, with ownership and control details. A shared brand or commercial partnership is not necessarily enough. The U.S. petitioner must be connected to the relevant foreign employer under the actual framework, not merely share a customer or director.
Document foreign employment in the proper window
The regulation requires qualifying managerial or executive employment abroad for the specified period within the relevant three-year window, with different reference points depending on the person’s situation. Preserve actual employment dates, entity identity and duties. Do not count a title without identifying what work was performed.
Read managerial and executive capacity functionally
The definitions concern primary responsibilities, discretion, organizational or essential-function management and relevant authority. First-line supervision does not automatically establish managerial capacity. An organizational chart helps explain relationships, but its boxes do not prove that the person primarily performs the duties claimed.
Check the U.S. business and offered role
The U.S. employer must meet the regulation’s doing-business requirement and offer managerial or executive work. Incorporation alone is not ongoing business activity. The regulation does not require labor certification, but that does not waive the employer, relationship or job-offer requirements.
Do not collapse L-1A and EB-1C
L-1A is a temporary-transfer framework and EB-1C is an immigrant classification. A prior L record can supply relevant history, but a separate immigrant review still examines its requirements. The free comparison distinguishes foreign role, U.S. role and business relationship without deciding whether a particular organization or position qualifies.
The regulation also requires the prospective U.S. employer to have been doing business for at least one year. That immigrant requirement should not be confused with the separate temporary L new-office framework. Keep incorporation, actual operating activity and the period being claimed identifiable in the business record.

| Relationship | Qualifying multinational organizations | What ownership/control evidence exists? |
| Foreign work | Required role and period | Which actual duties and dates are documented? |
| U.S. offer | Managerial/executive employment | What work will primarily be performed? |
