Does a technical degree alone establish L-1B specialized knowledge?
L-1B concerns an intracompany transfer involving specialized knowledge. The knowledge, qualifying business relationship, employment abroad and proposed U.S. duties need separate evidence. A technical degree, long service or a company’s preferred employee is not by itself the entire specialized-knowledge inquiry.

What this guide covers
- Identify the knowledge being claimed
- Connect the knowledge to real business activity
- Keep the intracompany relationship visible

- Separate project plans from established history
At a glance
- Define the actual specialized or advanced knowledge.
- Connect that knowledge to the proposed U.S. duties.
- Identify qualifying organizations and foreign employment.
Identify the knowledge being claimed
The regulation distinguishes special knowledge of the organization’s products, services or other interests and their international application from advanced knowledge of organizational processes and procedures. Describe the actual knowledge, how it was acquired and why the proposed U.S. work requires it. Avoid replacing the explanation with the word expert.
Connect the knowledge to real business activity
Product documentation, training history, project responsibility and actual work examples can explain the claim. The relevance is the knowledge and its proposed use, not the number of technical acronyms in a letter. Preserve confidential material through an appropriate process rather than inventing publicly shareable substitutes.
Keep the intracompany relationship visible
Specialized knowledge does not remove the qualifying-organization and foreign-employment requirements of L classification. Identify the overseas employer, U.S. petitioner and parent/branch/subsidiary/affiliate relationship. Commercial partnership alone is different from the qualifying organizational link.
Distinguish L-1B from L-1A and a general hiring case
L-1A concerns managerial or executive capacity, whereas L-1B concerns specialized knowledge. A person can have seniority without primarily managing, or hold company-specific expertise without qualifying under every category. The actual requested capacity determines the evidence question; this guide does not select it for the reader.
Separate project plans from established history
A proposed assignment explains future duties, while employment and training records describe what already occurred. Keep those sources distinct so an expected project does not become invented evidence of past knowledge. A prior L approval does not eliminate review of a materially different assignment or corporate relationship.
| Item | Actual distinction | Practical question |
|---|---|---|
| Knowledge | Special product/interests or advanced process knowledge | What is known and how was it learned? |
| Relationship | Qualifying intracompany link | How are the employers connected? |
| Capacity | L-1B rather than managerial L-1A | Which primary work is actually proposed? |
