Does Canadian or Mexican permanent residence qualify for TN?
TN concerns Canadian or Mexican citizens performing prearranged professional activities in an occupation listed by the USMCA framework. Citizenship, the listed profession, its specific credentials and the actual U.S. assignment must fit together. Canadian and Mexican initial visa/admission procedures differ.

Start with citizenship and the listed profession
A permanent resident of Canada or Mexico is not automatically eligible for TN on that basis. The professional activity must correspond to a listed occupation, with its stated minimum qualifications. A generic professional degree or an employer’s preferred title is not a substitute for reading the actual occupation entry.
Match duties to the profession rather than renaming the job
The regulation lists professions such as engineer, accountant, scientific technician and management consultant with different credential rules. Their requirements should not be collapsed into one degree standard. Describe the actual services and examine the correct entry instead of rewriting duties solely to resemble a listed title.
Keep the prearranged U.S. work identifiable
The framework requires prearranged professional activities for a U.S. entity and does not authorize establishing a business or practice in which the person is in substance self-employed. Keep employer/client letters, terms, duration and credentials distinct. A business incorporation owned by the applicant does not automatically solve that limitation.
Distinguish Canadian and Mexican procedures
The Department of State describes Canadian citizens as generally not requiring a TN visa before seeking admission, while Mexican citizens generally require the TN visa. Those procedural differences do not remove the substantive occupation and qualification requirements. A USCIS extension or employer-related request is another procedural context.
Separate dependent TD and professional licensing
A spouse or child’s TD classification does not provide TN professional work permission. A professional license can also be a separate state requirement even where immigration credentials are documented. The free table helps identify citizenship, occupation and entry questions without declaring an individual job to qualify.
| Item | Actual distinction | Practical question |
|---|---|---|
| Profession | Listed occupation with its own credentials | Do actual duties match the entry? |
| Citizenship | Canada or Mexico | Is residence being confused with nationality? |
| Procedure | Different initial visa/admission routes | Which country’s rule applies? |
